CONTRACT CONDITIONS
This agreement regulates the general conditions of purchase of the various products and services offered on this website by Excel Shower, SL with NIF nº B40634040 and address at Carretera Valencia-ademuz (km 21.5), Benissano, 46181 Valencia (SPAIN). Valencia Mercantile Registry Volume 10,773 General Section Folio 45 Sheet V-191094 Registration 1st Companies Book.
The CUSTOMER at the moment that completes the registration process, and buys any of our products, accepts and expressly submits to the clauses specified below, as well as to the conditions of access and use of our portal and its privacy policy, accessible through the link “Legal Notice”.
The CLIENT acknowledges having sufficient legal capacity to be contractually bound.
This contract is permanently accessible in the legal notices of our website.
1. PRICES AND TAXES
In consideration for the purchased product, the CLIENT expressly agrees to pay Excelshower the amounts specified at the time of purchase in the price list established on the excelshower.com website for the chosen products.
The products offered on this website are subject to Value Added Tax (VAT) which IS INCLUDED in the prices listed for each product.
The delivery of the items will be understood to be located in the VAT application territory if the delivery address is located in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at all times, depending on the specific article in question. In orders destined for the Canary Islands, Ceuta, Melilla, deliveries will be exempt from VAT, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.
In the case of shipments to countries of the European Union, the Spanish VAT will be deducted and the VAT tax rate corresponding to the country of destination will be applied.
In the case of application of import and/or customs duties, these will be borne by the recipient. These expenses may vary depending on the country of destination, so, in most cases, expenses cannot be estimated prior to delivery.
Transportation costs are NOT included in the price of the products.
Once the selection of products has been completed and prior to order confirmation and before proceeding to pay for it, the final purchase price will appear on the screen, including VAT (Value Added Tax), management fees , packaging and shipping, if applicable, which will be reflected in the purchase order at the time of purchase and on the invoice.
Everything that is not specified in the description as included is not included.
2. PURCHASE PROCEDURE
Orders may only be placed through this website by individuals over 14 years of age and companies.
On the website all our products are detailed individually. The procedure to make and manage the purchase is indicated on the website and only the following steps must be followed:
- Choose the product you want to purchase.
- When selecting a product, it can be added to the Shopping Cart and you can choose between continuing to buy or processing the order.
- To process the order you must fill out a form with your personal data to formalize the purchase procedure.
- Next, the order will be verified where the selected items are detailed one by one and the total price is calculated.
- Likewise, it will be necessary to indicate the billing and delivery addresses of the purchase made. It will be possible to indicate a single address for billing and delivery.
- Once the process has been processed, it will be necessary to previously check a checkbox for reading and accepting the terms and conditions of sale.
- The website will provide you with the mechanisms so that payment can be made based on the system chosen in each case.
- Once the data for payment has been entered, you must confirm the order by pressing the “Place order” button.
- Once the “Place order” button has been pressed, the order confirmation will be sent by email.
The CLIENT is informed that the photographs and descriptions of the products on the website are an approximate image of the products and services offered, so it is possible that they may differ from the original. The descriptions and illustrations of the products offered through this website are made for informational purposes only.
3. AVAILABILITY AND DELIVERY
The products offered by Excelshower are available for distribution anywhere in the world.
Orders will be processed once payment has been successfully received.
The products offered by Excelshower will always be subject to availability, which will be specifically indicated on our website for each product, so that if an item offered is not available, the customer will be duly informed of the lack of availability for purchase. Under normal conditions, all the products that appear on our website are available for delivery within the indicated periods.
In cases where, once the order has been placed, the product contracted by the CUSTOMER is out of stock, they will be duly informed of this and an alternative product with similar characteristics of the same price and quality as the one purchased will be offered. If even so, the CUSTOMER is not interested in accepting the proposed alternative, Excelshower will proceed to return the amount already paid and will inform him of the reimbursement procedures and deadlines.
As a general rule, the maximum delivery time at home or at the delivery point will be 10 days from the time of purchase and from the time we have confirmed your payment. These delivery times are approximate and in no way binding for Excelshower.
Deliveries will be made on working days (Monday to Friday). The delivery of the purchased product will be at home or at the delivery point, at the CUSTOMER’s choice:
Home delivery will be made by the carrier together with a delivery note to the address indicated in the order form that the customer must sign as a receipt document.
If delivery to the indicated address is not possible due to the absence of the recipient, the carrier will contact the CUSTOMER directly to agree on either a delivery time or the removal of the package at a specific point or, indicating, in all case, the steps to follow.
In the event that the impossibility of delivery is caused by having entered an erroneous address, the cost of reshipping the order will be borne by the CUSTOMER.
The CUSTOMER who chooses the option to pick up the order at the delivery point will receive a confirmation email when it can be picked up. If the CUSTOMER does not pick up the order within 15 days, a reminder email will be sent.
In both deliveries, once the collection period has expired, if the CUSTOMER has not collected their order, it will be returned to our warehouse and an email will be sent indicating how the delivery will finally be made. In the latter case, the shipping costs will be borne by the CUSTOMER. In addition, Excelshower is not responsible for delays in product deliveries due to causes attributable to the carrier.
In order to be informed at all times of the management of your purchase, you will receive an email confirming your order and payment. Likewise, in the confirmation the CUSTOMER will receive by email the instructions to check the status of his order. The CLIENT will be duly informed in the event that an incident occurs or the delivery is delayed for any reason.
4. PAYMENT AND PAYMENT PERIODS
The following forms of payment are accepted:
Debit and Credit Card: The transaction is carried out by connecting directly with the Banco Santander bank through its payment gateway.
Excelshower has no knowledge of the data relating to your card. All our payment systems are completely secure.
Bank transfer: Make your payment directly into our bank account. Please use the order number as a payment reference. Your order will not be processed until the amount has been received in our account. BBVA contract holder with IBAN ES62 0182 0565 3002 0244 9669 and CIF: B40634040.
Once the payment is made, you will receive a confirmation email.
Payments are prior to product delivery, so Excelshower will not provide the requested product until payment has been received. Excelshower reserves the right to temporarily or permanently cancel the services provided, in the event of any incident in terms of collection thereof.
5. INVOICES
When making the corresponding payment, you will receive the Invoice of your purchase in PDF format in the email that you have indicated for this purpose at the time of processing the order.
The CLIENT is responsible for confirming receipt of the notifications and for informing us of any changes to their data, with Excelshower being exonerated from any liability arising from this circumstance.
6. WARRANTY
Excelshower will be liable for any lack of conformity of the products sold that become apparent within a period of two years from the date of purchase. For its part, the CUSTOMER must inform Excelshower of the lack of conformity of the purchased product within two months of becoming aware of it. The guarantee only covers defective products, any manufacturing, design or material defect, although it will be necessary for the lack of conformity to be revealed within the period indicated from the time it became known. It does not cover improper use, or others that are not attributable to a supplier defect or a defect in the product.
The repair, replacement or as appropriate will be carried out, in any case being free for the CLIENT, who will not have to bear the necessary expenses incurred to correct the lack of conformity of the products with the contract (especially shipping costs), nor the costs related to labor and materials used in the repair, if any. The guarantee document is the purchase invoice.
7. RETURNS
The following conditions for the return of our products do not apply in the case of exercising the right of withdrawal.
Returns or exchanges of products will only be accepted in case of manufacturing defect, transport damage or delivery errors. In any case, no more than 14 days must have elapsed since receipt of the product and the packaging and accessories must be included. It will be verified prior to acceptance that it is a manufacturing or packaging defect or anomaly and not improper or negligent use, handling or storage. They will always be accompanied by the corresponding delivery note or invoice.
Both in the case of a return due to a manufacturing or packaging defect and in the case of an error in the order, the CUSTOMER will be offered, if possible, the substitution for another alternative at no additional cost and without the CUSTOMER’s right to any type of of compensation. The expenses generated by the shipment of the repaired or correct order will be borne by Excelshower.
In any case, the return will always be subject to prior examination by Excelshower of the condition of the product being returned and verification that the requirements in these conditions of sale have been met. Once the return is received and if applicable, we will refund the amount charged within a maximum period of 30 days and in the same terms that were used to make the payment.
Excelshower reserves the right to refuse returns communicated or sent after the deadline or products that are not in the same conditions in which they were received.
Returns will be managed by sending an email to info@excelshower.com describing the reasons and causes alleged for the return. Likewise, it will be necessary to indicate the name and surnames and the reference number of the order. Once the request is received, we will process it in a timely manner.
